Pledje Fundraising Solutions (“we,” “us,” or “Pledje”) provides a digital platform designed to assist organizations in conducting fundraising campaigns (“Organizations”) and enables users to contribute to these campaigns and charitable causes of their preference (“Charities”). These User Terms of Service (“Terms”) constitute a legally binding agreement between Pledje and you, the user. The term “User” or “you” refers to any individual or entity accessing or utilizing the Services provided by Pledje. By accessing or using the Pledje website (the “Site”) or any sub-site created for the Organizations, as well as any services provided by us, including any associated mobile applications (collectively, the “Services”), you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.Should you disagree with these Terms or the Privacy Policy, please refrain from accessing or using the Services.
We retain the right, at our sole discretion, to revise or modify these Terms at any time, and your continued use of the Services after such revisions constitutes your acceptance of the updated Terms. It is your responsibility to periodically review these Terms.
Subject to the conditions outlined herein, Pledje grants you non-exclusive access to and use of the Services during the term of these Terms. Pledje reserves the right to alter, modify, or update the Services, including the removal of functionalities, without prior notice. While Pledje currently offers the Services free-of-charge, we may choose to implement charges for future use. To access the Services, you must be 18 years of age or older, or have parental or guardian consent. Your access or use of the Services must not breach any applicable laws or regulations.
You can register for Pledje by providing the necessary information. We reserve the right to modify the registration process at our discretion. Pledje retains the right to deny any user account at its sole discretion. You agree to furnish accurate and complete information during account creation and subsequent use of the Services. Any changes to this information must be promptly updated by you.
You are prohibited from sharing your account or login details with any third party or allowing third-party access to your account. You are responsible for maintaining the confidentiality of your account login information. You bear full responsibility for your computer system’s security, mobile devices, and all activities conducted through your account, even those not performed by you. Pledje reserves the right to terminate your access to the Services if your account is used inappropriately or if you or anyone using your account violates these Terms. Promptly inform us of any unauthorized account use. Pledje is not liable for losses or damages resulting from unauthorized Services use. You agree to indemnify and hold Pledje harmless for any improper or illegal use of the Services unless reported via email to [email protected].
We reserve the right, at our discretion and without notice, to terminate your account for various reasons, including prolonged inactivity, violations of these Terms, fraudulent, harassing, or abusive behavior, or actions detrimental to other users, third parties, the community ethos of our Services, or our business interests. If your account is terminated, re-registration for Services requires our explicit permission. If you believe any action against your account is mistaken, contact us at [email protected]. Moreover, if we suspect a breach of these Terms or any illegal or inappropriate behavior, we may take appropriate corrective action. We also reserve the right to investigate suspected violations or illegal behavior and will cooperate fully with law enforcement investigations or court orders requiring disclosure of the identity, behavior, or activities of those breaching these Terms or engaging in illegal activities. You may request account termination at any time by emailing [email protected]. The suspension or termination of your account does not affect your obligations under these Terms (including ownership, indemnification, any representations and warranties made by you, and limitation of liability), which are intended to survive such suspension or termination.
Pledje Fundraising Solutions facilitates public donations to campaigns ("Donors") and enables contributions directly to specific Charities. Any donation made to a Charity through our Services will be subject to a Services fee. Please note that Pledje is not a charity. If you or your charity wish to register to be listed as a charitable organization on our Platform, kindly contact us at [email protected] for assistance in this process. While we strive to list legitimate and worthy Organizations and/or Charities, we cannot guarantee the actual activities of such entities. We bear no responsibility for the accuracy of information provided by Organizations and/or Charities. Prior to selecting a specific Organization and/or Charity, you must conduct your own research, and we do not vouch for the worthiness or standards of any such entity. Our Services serve as an administrative platform. Pledje facilitates donation transactions between Organizations and/or Charities and users but is not a party to any agreement between them. We do not act as a broker, agent, financial institution, creditor, or insurer for any user. Pledje disclaims all liability regarding the conduct of, or information provided by, Organizations and/or Charities or their representatives, as permitted by law. We cannot guarantee that a particular campaign, Organization, and/or Charity will receive specific donations or any donations at all. We do not personally endorse any campaign and do not assure the accuracy of information provided by a user through the Services. We explicitly disclaim liability or responsibility for the success of any campaign or fundraising purpose. As a donor, you are responsible for determining the value and appropriateness of contributing to any campaign or Organization and/or Charity. We do not verify the information provided by Organizations and/or Charities, nor do we ensure that donations will align with the intended fundraising purpose. It is the sole responsibility of Organizations and/or Charities to use donations in accordance with applicable laws. While we are not obligated to verify the proper use of raised funds, we take fraudulent activity and fund misuse seriously. If you suspect misuse of funds by an Organization and/or Charity, contact us at [email protected]. Donors may also be covered by the pledje Guarantee, details of which can be found on this page.
Donations are currently accepted via major credit cards, checks, or ACH transfers. Pledje reserves the right to add or modify payment methods at its discretion. Users must adhere to the terms and conditions of their chosen payment method. Users are solely responsible for any applicable taxes on amounts paid or received through the Site. Pledje will deduct relevant charges and taxes from payable amounts as required by law. When a user pledges a donation, Pledje sends a notification to the user. Donors agree to provide payment information at the time of pledging to a fundraising campaign. A hold will be placed upon pledging, and if the campaign succeeds, payment will be collected at or after the campaign deadline. After donation, donors receive an automatically-generated receipt via email. However, due to spam filters and connectivity issues, receipt delivery is not guaranteed. Donors consent to Pledje and its payment partners authorizing a hold or charge on their payment method for the pledged amount at the time of the pledge and upon campaign completion. Donors agree to have sufficient funds or credit available at the campaign deadline to ensure collectibility of the pledge. Pledje does not offer refunds. Nonprofit organizations are not required to grant refund requests from donors. Due to chargebacks, Pledje does not guarantee that the charity will receive the full pledged amount minus fees. Pledje and its payment partners deduct fees before transmitting campaign proceeds. Fee structures may vary, currently set at 2.9% + 30c per credit card transaction and 0.8% (up to $5.00) for ACH transfers. Pledje reserves the right to cancel a pledge at any time and for any reason, as well as reject or suspend a campaign without liability for resulting damages. Pledje does not comment on the reasons for such actions. For all campaigns, Pledje provides the nonprofit with each donor’s name, email, mailing address, and pledged amount. Nonprofit organizations should refrain from taking action based on having their campaign posted on the Site until they have access to and authorization to use the funds. There might be a delay between a successful campaign’s conclusion and fund accessibility, typically up to one week. Pledje disclaims liability for any damages or losses incurred through Service use. We are not obligated to mediate disputes between users or between users and third parties arising from Service use. Pledje does not oversee fund usage for campaign purposes or endorse user submissions. Users release Pledje and its officers, employees, agents, and successors from claims, known or unknown, arising from such disputes and Service use.
Pledje and its licensors hold all rights to the Services and any content available through them, globally owning associated intellectual property rights. Except as explicitly permitted, users may not copy, reproduce, modify, or use materials from the Services. Users must not remove or conceal copyright, trademark, or other proprietary rights notices in the Services. Trademarks belong to their respective owners, and these Terms grant no right to use any trademark, service mark, logo, or trade name. User feedback or suggestions regarding Services modification may be used or published at Pledje's discretion without confidentiality obligations.
Pledje Fundraising Solutions enables users to submit comments, reviews, or other materials on the platform ("Submissions"). This includes any content transmitted to the site or another user, encompassing text, audio, or visual materials. Users bear responsibility for all Submissions they post or transmit. By submitting content, you affirm that it doesn't violate any third-party intellectual property, moral, publicity, or privacy rights, and that you possess all rights necessary for its posting or transfer. We do not pre-screen Submissions but retain the right, at our discretion, to remove any that breach these Terms. While we don't claim ownership of your Submissions, by submitting content, you grant Pledje Fundraising Solutions a non-exclusive, royalty-free, perpetual license to utilize, edit, modify, reproduce, publish, display, and distribute Submissions globally, in any manner, medium, or context, including for promotional purposes. You agree not to: (a) solicit personal information under false pretenses; (b) impersonate others; (c) violate legal rights, defame, abuse, stalk, or threaten users; (d) infringe third-party intellectual property, privacy, or moral rights; (e) post illegal, fraudulent, unauthorized, or offensive material; (f) violate applicable laws, rules, or regulations; (g) publish falsehoods or misrepresentations; (h) post libelous, defamatory, obscene, or offensive content; (i) transmit harmful components like viruses; (j) interfere with security-related features or content restrictions; or (k) use automated processes to access or mine Services data. Pledje Fundraising Solutions does not endorse or take responsibility for Submissions, disclaims liability, and warns users about exposure to inaccurate, offensive, or objectionable content. By using the platform, you waive any legal rights or remedies against Pledje Fundraising Solutions concerning Submissions.
Your use of our Services is at your own risk. Pledje Fundraising Solutions disclaims all liability for activities undertaken through the platform. We provide Services "as-is," without warranties of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the accuracy, completeness, reliability, or error-free nature of information regarding charitable organizations and charities provided through the platform.
To the maximum extent permitted by law, Pledje Fundraising Solutions shall not be liable to you or any third party for any damages arising from the Services or content. Our liability under these Terms shall not exceed amounts paid directly to us for Services use. We assume no responsibility for errors, interruptions, technical malfunctions, or damages resulting from platform use, online or offline.
You agree to indemnify and hold Pledje Fundraising Solutions harmless against any claims, damages, losses, liabilities, costs, or expenses arising from: (a) breach of these Terms; (b) use or attempted use of Services; (c) violation of laws or regulations; (d) infringement of third-party rights; or (e) any matter for which you're responsible under law.
Under the Digital Millennium Copyright Act of 1998 (DMCA), we respond to copyright infringement claims. Send notices and counter-notices to [email protected].
These Terms are governed by the laws of Los Angeles, CA. Any action related to these Terms shall be exclusively brought in the courts located in Los Angeles. If any provision is unenforceable, it shall be replaced to achieve the original intent. These Terms constitute the entire agreement between us and supersede any other agreements or understandings.
